Do you feel like the current proposed HOS will make your life as a driver better or worse? It is your right to speak up and have your opinion heard. We need to let our Government know that we will not be forgotten about in their law making decisions.  We feel like the law makers should have some idea of what it is like to drive a truck for a living. There is no way a person can imagine what it is like. So why don't you tell them what needs to be fixed in the Trucking industry.

 The Transportation Safety Act

Even though motor carriers are included in the Transportation Safety Act of 1971 which charges the NTSB to investigate any fatal accidents involving aircraft, trains, ships or trucks, they do not investigate truck accidents on site and rely solely on the police report for their information. They are supposed to reconstruct accidents and investigate preimposing factors which are related to the accident but do so only for trains, planes and ships.

The DOT uses antiquated factors from the insurance underwriters in determining preventable and non preventable accidents that were set in place about the time the hours of service were put into law about 40 years ago. Even if the trucker proves the car caused the accident if the trucker is not in one of four very restrictive categories, he/she is still tag with a preventable accident.

Statistics now prove that 70% of the fatal truck/car crashed in 1997 and 1998 were caused by the car driver, 16% by the truck driver and 14% by a combination of both.

Lumpers...

Is it legal to make a driver pay or his trailer to be loaded or unloaded?? You be the judge....

Here's the US codes regarding "lumpers" They are illegal, so how does this happen?

(Excerpts from 1980 H.R. Rpt. No. 96-1069, 96th Cong., 2d Sess., pp.30-31)§ 11109 (49 U.S.C. § 11109 reads:

>(a) Whenever a shipper or receiver of property requires that any person who owns or operates a motor vehicle transporting property in interstate commerce (whether or not such transportation is subject to the jurisdiction of the Commission under subchapter II of Chapter 105 of this title) be assisted in the loading or unloading of such vehicle, the shipper or receiver shall be responsible for providing such assistance or shall compensate the owner or operator for all costs associated with securing and compensating the person or persons providing such assistance.

(b) It shall be unlawful to coerce or attempt to coerce any  person providing transportation of property by motor vehicle for compensation in interstate commerce (whether or not such transportation is subject to the jurisdiction of the Commission under subchapter II of chapter 105 of this title) to load or unload any part of such property onto or from such vehicle or to employ or pay one or more persons to load or unload any part of such property onto or from such vehicle, except that this subsection shall not be construed as making unlawful any activity which is not unlawful under the National Labor Relations Act or the Act of March 23, 1932 (47 Stat. 70; 29 U.S.C. 101 et seq.), commonly known as the Norris-LaGuardia Act.

PENALTIES FOR VIOLATIONS OF RULES RELATING

TO LOADING AND UNLOADING

§ 11902a. (49 U.S.C. § 11902a.) reads: (a) Any person who knowingly authorizes, consents to, or permits violation of subsection (a) or (b) of section 11109 of this title or who knowingly violates subsection (a) of such section is liable to the United states Government for a civil penalty of not more than $10,000 for each violation. (b) Any person who knowingly violates section 11109 (b) of this title shall be fined not more than $10,000, imprisoned for not more than 2years,or both.

We will add new issues here as we can. We feel like being able to log all the email that is sent to our government will help in our cause. Of course there is no way for us to log every single email that has been sent thus far and some will not want to send their comments through us, we still feel that keeping a record of as many as we can will help to get the attention to these issues that they deserve.
